Last updated: July 2026

These Terms of Service ("Terms") govern your use of the website thetenderco.com.au and any tender writing or bid consulting services provided by The Tender Co. Advisory ("The Tender Co.", "we", "us", "our").

By using our website or engaging our services, you agree to these Terms. If you do not agree, please do not use our website or services.

About us

The Tender Co. Advisory is a Canberra-based tender writing and bid consulting business, ABN 78 404 972 608, servicing clients across Australia.

Our services

We provide tender writing, tender review and editing, bid strategy, capability statement writing, expression of interest (EOI) writing, and tender training services. The specific scope, deliverables, timeline, and fees for any engagement will be agreed in writing (including via email) before work begins.

Enquiries and quotes

Submitting an enquiry through our website does not create a binding agreement between you and The Tender Co. A formal engagement only begins once both parties have agreed on scope, fees, and timeline, typically confirmed in writing.

Quotes provided are estimates based on the information available at the time and may be revised if the scope of work changes.

Client responsibilities

To deliver an effective tender response, we rely on you to:

While we write to the highest professional standard, the client remains responsible for reviewing and approving the final document before submission, and for ensuring compliance with all tender conditions.

No guarantee of outcome

While we are committed to producing the strongest possible tender response, The Tender Co. cannot guarantee that any tender, bid, or submission will be successful. Tender outcomes depend on many factors outside our control, including the decisions of the procuring organisation.

Confidentiality

We treat all client information, business data, and pricing as strictly confidential. We are happy to sign a Non-Disclosure Agreement (NDA) for any engagement upon request, and as standard practice will not share your information with third parties without consent.

Intellectual property

Upon full payment, ownership of the final written tender response transfers to the client for the purpose of submission. The Tender Co. retains the right to use general methodologies, templates, and non-confidential approaches developed during an engagement for future client work.

Payment terms

Payment terms will be agreed in writing as part of each engagement. Late payment may result in a pause of services until accounts are brought up to date.

Limitation of liability

To the extent permitted by Australian law, The Tender Co.'s liability for any claim arising from our services is limited to the value of fees paid for that specific engagement. We are not liable for indirect or consequential loss, including loss of contracts, revenue, or business opportunity.

Website use

You agree to use this website only for lawful purposes. We make reasonable efforts to keep the website accurate and available but do not guarantee uninterrupted access or that the website will be free of errors.

Changes to these Terms

We may update these Terms from time to time. Continued use of our website or services after changes are made constitutes acceptance of the updated Terms.

Governing law

These Terms are governed by the laws of the Australian Capital Territory, Australia, and any disputes will be subject to the jurisdiction of the courts of the ACT.
